Interpretation: The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

    This Privacy Notice describes how Rydex Mobility Services ("Rydex") collects and uses personal data. This Notice applies to all users of our apps, websites, features, or other services anywhere in the world.

    Scope: This Notice applies specifically to:

  • ●Riders: individuals who request or receive transportation and related services.
  • ●Drivers: individuals who provide transportation to Riders individually or through partner transportation companies.
  • ●Delivery Recipients: individuals who request or receive food or other products and services.
  • ●Delivery Persons: individuals who provide delivery services.
  • ●Guest Users: individuals who receive services through accounts owned by other Rydex users (e.g., when a Rider requests a ride for someone else).
  • ●Partners: individuals or entities that partner with Rydex to provide services or products.

    • Our practices are subject to applicable laws in the places in which we operate. This means that we only engage in the practices described in this Notice in a particular country or region if permitted under the laws of those places.

    III. What Personal Data We Collect

    A. Data Provided by You

    We collect data provided by you when you create or update your Rydex accounts, use our services, or contact us. This includes:
  • ●User Profile Data: Name, email, phone number, login name and password, address, profile photo, and signature.
  • ●Identity Verification Data: We may collect photos of government-issued IDs (such as driver’s licenses, passports, or national ID cards) and user-submitted selfies. This may include biometric data generated from such photos to verify your identity and age.
  • ●Payment Data: Details of your payment methods, including credit/bank card info, related payment verification information, and transaction history on the Rydex platform.
  • ●Demographic Data: Age, gender, and language preferences.
  • ●User Content: Information you submit when you contact Rydex customer support, provide ratings or feedback for other users, or respond to surveys.

    • B. Data Created During Use of Our Services

    This includes data created when you use our apps, websites, and other services.
  • ●Geolocation Data: We collect precise or approximate location data from your mobile device if you enable us to do so. For drivers and delivery persons, we collect this data when the app is running in the foreground or background (permission: `ACCESS_BACKGROUND_LOCATION`) to enable ride matching, navigation, and trip tracking. For riders, we collect this data when the app is running in the foreground and may collect it in the background if enabled for specific features like safety monitoring.
  • ●Audio and Microphone Data: We may collect audio data if you use features that require the microphone (permission: `RECORD_AUDIO`), such as voice commands, in-app voice communication, or safety recording features where available.
  • ●Files and Media: We request access to your device's storage and gallery (permissions: `READ_EXTERNAL_STORAGE`, `READ_MEDIA_IMAGES`) to allow you to upload profile pictures, identity documents, or evidence for support tickets.
  • ●App Usage Data: Information about how you interact with our services, including access dates and times, app features or pages viewed, app crashes, and browser type.
  • ●Transaction Data: Details related to your use of our services, including the type of service requested, date and time the service was provided, amount charged, distance traveled, and payment method used.
  • ●Device Data: Data about the devices used to access our services, including hardware models, device IP address, operating systems and versions, unique device identifiers, and mobile network data. We also request permissions for features like vibration (`VIBRATE`) and screen wake (`WAKE_LOCK`) to ensure you receive critical alerts during a trip.
  • ●Notifications: We request permission to send you notifications (`POST_NOTIFICATIONS`) regarding ride status, account updates, and promotional offers. We may also use exact alarms (`SCHEDULE_EXACT_ALARM`) to ensure timely delivery of these notifications.
  • ●Communication Data: We enable users to communicate with each other and Rydex via our apps and websites. We collect data regarding these communications, including the time, date, and content of the messages. We also facilitate calls and SMS between users (using `tel` and `sms` schemes) without revealing your actual phone number where possible.
  • ●Biometric Authentication (Drivers Only): The Rydex Driver app uses your device's built-in biometric authentication (fingerprint or facial recognition) to verify your identity before performing sensitive actions, such as going online and processing withdrawals. This authentication is handled entirely by your device's operating system (iOS Secure Enclave or Android Trusted Execution Environment). Rydex does not collect, access, or store your biometric data. We only receive a pass or fail confirmation from your device. You may always fall back to your device PIN or password if you prefer not to use biometrics.

    • C. Data from Other Sources

    This includes data from:
  • ●Rydex partners through which you create or access your Rydex account.
  • ●Users who provide your data in connection with referral programs.
  • ●Users who request services for you or on your behalf.
  • ●Third-party service providers who help us verify your identity, background information, or eligibility to work.

    • IV. How We Use Your Data & Legal Basis

    A. Purpose of Processing

    We use the data we collect for purposes including: 1. Providing Services and Features: To create, update, and maintain your account; enable transportation and delivery; personalize your experience; and perform necessary operations to maintain our services, including troubleshooting software bugs and operational problems. 2. Safety, Security, and Fraud Prevention: We use data to help maintain the safety, security, and integrity of our services and users. This includes verifying your identity, age, or eligibility to provide or receive services; and preventing, detecting, and combating fraud or unsafe activities. 3. Customer Support: We use the information we collect (including recordings of customer support calls after notice to you and with your consent) to assist you when you contact our customer support services. 4. Research and Development: We may use the data we collect for testing, research, analysis, product development, and machine learning to improve the user experience and enhance the safety and security of our services. 5. Marketing and Advertising: Rydex may use data to market our services and those of Rydex partners. This includes sending promotional communications, and identifying and analyzing usage trends. 6. Non-Marketing Communications: We may use data to generate and provide you with receipts; inform you of changes to our terms, services, or policies; or send other communications that are not for the purpose of marketing the services or products of Rydex or its partners. 7. Legal Proceedings and Requirements: We may use the personal data we collect to investigate or address claims or disputes relating to use of Rydex's services, or as otherwise allowed by applicable law, or as requested by regulators, government entities, and official inquiries.

    B. Legal Basis for Processing

    We reliance on the following legal bases to process your personal data:

    Rydex may share your data:

  • ●With Other Users: E.g., sharing a rider’s first name and pickup/dropoff location with a driver to enable the ride. We also share driver ratings and feedback with the driver (after removing your identity).
  • ●With Account Owners: If you use an account owned by another party (e.g., a Rydex for Business profile or a Family profile), we may share your trip details with the account owner.
  • ●With Rydex Service Providers and Partners: E.g., sharing data with payment processors, identity verification partners, cloud storage providers, and marketing partners to perform services on our behalf.
  • ●With Other Parties at Your Request: E.g., sharing your estimated time of arrival and location with a friend at your request.
  • ●For Legal Reasons: We may share your personal data if we believe it is required by applicable law, regulation, operating agreement, legal process, or governmental request, or where the disclosure is otherwise appropriate due to safety or similar concerns.
  • ●In Connection with Business Transfers: We may share or transfer your data in connection with, or during negotiations of, any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

    Rydex and its partners use cookies and other identification technologies on our apps, websites, emails, and online ads for purposes described in this Notice.

    VII. Data Retention and Security

    A. Data Retention

    Rydex retains your personal data for as long as necessary for the purposes described in this Notice. Retention periods vary depending on the type of data and why we collect it.
  • ●Account Data: We retain your account information for as long as you maintain your Rydex account.
  • ●Legal and Regulatory Data: We may retain certain data (e.g., transaction records, tax data) for up to 10 years after your last trip to comply with laws and regulations.
  • ●Identity Verification Data: Photos of IDs are typically deleted within 48-72 hours of verification, though we may retain the verification status for as long as you have an account.
  • ●Safety and Fraud Prevention: We may retain data for up to 7 years (or longer if required) if necessary for safety incidents, fraud prevention, or defending against legal claims.
  • ●Communications Data: Chat messages between users are typically retained for 90 days unless related to a reported incident.

    • Following an account deletion request, Rydex deletes the user's account and data, unless they must be retained due to legal or regulatory requirements, for purposes of safety, security, and fraud prevention, or because of an issue relating to the user's account such as an outstanding credit or an unresolved claim or dispute.

    B. Data Security

    The security of your personal data is a priority. We use commercially acceptable technical and organizational measures to protect your data. However, no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to protect your personal data, we cannot guarantee its absolute security.

    VIII. Your Rights and Choices

    Rydex enables users to access and control the data that we collect, including through:

  • ●Privacy Settings: You can manage location and notification settings in the Rydex app.
  • ●Device Permissions: Most mobile device platforms have defined certain types of device data that apps cannot access without your consent.
  • ●Marketing Choices: You may opt out of receiving promotional emails or messages from Rydex.

    • User Rights: Depending on your location, you may have the following rights regarding your personal data:

  • ●Right of Access: You can request copies of your personal data.
  • ●Right of Rectification: You can request that we correct inaccurate or incomplete data (many details can be updated directly in the app).
  • ●Right of Erasure: You can request that we delete your personal data, subject to certain exceptions (e.g., where we are legally required to keep it).
  • ●Right to Object: You may object to our processing of your personal data for certain purposes, including direct marketing and profiling.
  • ●Right to Data Portability: You may request that we transfer your data to another organization or directly to you in a structured, commonly used format.
  • ●Biometric Settings: If you are a driver, you can enable or disable biometric authentication at any time through your app's settings. Disabling biometrics will require you to use your device PIN or password for sensitive in-app actions. Rydex holds no biometric data, so there is nothing to delete on our end.

    • IX. Children's Privacy

    Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If you are a parent or guardian and you are aware that your child has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from anyone under the age of 13 without verification of parental consent, we take steps to remove that information from our servers.

    X. Changes to this Privacy Policy

    We may occasionally update this Privacy Policy. We will notify you of any significant changes by posting the new Privacy Policy on this page and/or via email or app notification. We encourage you to periodically review this page for the latest information on our privacy practices. Use of our services after an update constitutes consent to the updated notice to the extent permitted by law.
